Terms of Service

1. Service provider

The Basal Generator service (guardian.nasiadka.pl, the Android app "Basal Generator" and the token upload program) is provided free of charge by Maciej Nasiadka (the "Provider"). Contact: the contact form at https://guardian.nasiadka.pl/contact or maciejnasiadka@wp.pl.

2. What the service does

With your consent and on your behalf, the service downloads the history of insulin delivery from your Medtronic CareLinkā„¢ account and presents it as charts and statistics, including the average hourly SmartGuardā„¢ basal delivery. The service is free of charge and gives no guarantee that the data is complete or up to date.

Technical requirements: a current web browser with JavaScript and cookies enabled, or an Android 11+ device for the app. Connecting CareLink requires a computer (Windows, macOS or Linux) or the Android app.

3. Account

  • You must be at least 16 years old; younger persons need the consent of a parent or legal guardian, who then answers for the account.
  • Use an email address you control and keep your password confidential. You are responsible for what happens on your account.
  • One account per person. If you connect the CareLink account of another person (e.g. your child), you confirm that you are entitled to do so.
  • You can delete your account at any time with the "Delete account" button; what happens to your data is described in the Privacy Policy.

4. Connecting CareLink

To fetch your data the service stores access tokens issued by CareLink (details in the Privacy Policy). You connect your CareLink account on your own initiative, and you are responsible for being entitled to do so and for complying with the CareLink terms of use.

The service is an independent project, not affiliated with, authorized or endorsed by Medtronic. CareLink may change or restrict access to its data at any time, which can stop synchronization without notice. The Provider has no influence over this and is not liable for it.

5. Not medical advice

The service is not a medical device and is an informational tool. Its results are statistics of historical pump data - not medical advice, a diagnosis, or a recommendation of treatment or pump settings. Never change pump settings or insulin dosing on the basis of these results without consulting your diabetologist or doctor. You use the results at your own risk and responsibility.

6. Acceptable use

You must not:

  • use the service in breach of the law or these Terms,
  • try to gain unauthorized access to the service, to other users' accounts or data, or disrupt how the service works,
  • send automated or excessive requests (scraping, load generation) or bypass rate limits,
  • provide data of other persons without the right to do so.

7. Availability and changes

The service is provided "as is", without a guarantee of uninterrupted operation. The Provider may change, suspend or discontinue the service or any part of it; where reasonably possible, a planned discontinuation will be announced in advance by email or on the website.

8. Liability

The Provider is liable under generally applicable law. To the extent permitted by law, the Provider is not liable for decisions made on the basis of the service's results, for incomplete or outdated data caused by the way CareLink works, or for temporary unavailability of the service. This does not exclude liability for damage caused intentionally or any liability that cannot be excluded by law, and does not limit your rights as a consumer.

9. Termination

You can stop using the service and delete your account at any time. The Provider may block or delete an account that breaches these Terms (e.g. abuse of or attacks on the service) - after a warning where possible.

10. Reports and complaints

Any comments and complaints about how the service works (e.g. errors, data not synchronizing) can be sent through the contact form or by email. The Provider will review the report and reply within 14 days.

11. Changes to these Terms

The Provider may change these Terms for important reasons, e.g. a change in the law or in the scope of the service. Registered users will be informed by email or on the website at least 14 days before the change takes effect. If you do not accept it, you can delete your account before then.

12. Final provisions

These Terms are governed by Polish law. Mandatory consumer protection provisions of the law of your country of residence remain unaffected. How your personal data is processed is described in the Privacy Policy (/privacy).
